The Supreme Court annulled the PGOU of Marbella 2010

In early November, the Supreme Court overturned the General Urban Plan (PGOU) of Marbella 2010. This plan legalized more than 16,500 illegally built homes during the era of GIL.
The Supreme considers that the PGOU has no power to legalize what is illegal, the plan doesn´t meet environmental standards and doesn´t provide information about economic sustainability.
The General Plan drawn up by the developer Manuel Gonzá lez Fustegueras, was adopted with the support of PP and PSOE parties, and sought to legalize thousands of homes, forcing promoters to pay with financial compensation and ground.
Despite the cancellation, the Supreme understands the situation the city is passing by, the disastrous results of urban management conducted in the past and that they are aware of the goodwill of the City Council and the Government of Andalusia, seeking to regularize the situation of these households to turn the page.
TS judgments that annul the PGOU of 2010, recovered the 1986 plan, the one that was not respected by Jesús Gil and colleagues. The decision of the high court is causing concern among the population and mistrust of developers, although it is still early to know the financial implications of the judgment.
In this sense, the mayor José Bernal has sent a message to investors; legal certainty and urbanism of the city will not suffer any ill effects and that the 1986 plan will undergo adaptations and modifications, so the licenses that have been granted so far are firm and legal. It also states that the City Council is working with the Andalusian Ministry of Planning, headed by José Fiscal, who visited the city to discuss the matter. They are trying also to reassure buyers, since two of the judgments of the Supreme could affect to urban homeowners, not to promoters. The mayor sits alongside citizens and insists that their interests will be defended.
From  Málaga Provincial Council has urged the team of Marbella government to take solutions as soon as possible, and that aside from fiscal pressure and bureaucratic dispersion, the legal uncertainty of the new scenario may pose a negative impact on a time during which the construction sector is recovering.
The mayor answered that they are working on the new General Plan, which hope to present in two or three years and that this serves to solve the problems  the city has for 30 years. In addition the townhall reported that investments are still standing and an investor group has recently acquired two plots totaling 22 million euros to build housing for affluent buyers. It has also announced purchases of land in Marbella worth 100 million euros in the last month, which notifies that nothing is affecting the confidence of investors.
